PHOTOGRAPHY TERMS AND CONDITIONS
TERMS & CONDITIONS 2025
LAW
These Terms and Conditions shall be governed and construed in accordance with the Laws of England.
BOOKED SERVICES
The client(s) agrees to book the photographer for the services outlined in this contract. The client(s) acknowledge that the booked services cannot be downgraded to fewer hours than those specified in their chosen photography package.
COPYRIGHT
The client(s) are granted permission to reproduce, print, and display the images solely for personal use. All images are protected under the Copyright, Designs, and Patents Act 1988. Under this Act, it is illegal to copy, reproduce, or permit the reproduction of any image created as part of this contract without written consent from the photographer.
WEBSITE DISPLAY & PROMOTIONAL USAGE
The client(s) hereby grant(s) the photographer permission to use any photograph covered by this contract for the purpose of promoting the business, including but not limited to advertising, brochures, magazine articles, websites, sample albums, and other promotional materials.
While the photographer will make reasonable efforts to protect these photographs from malicious activity, they cannot be held liable for any such actions caused by individuals other than the photographer.
LIABILITY
The Photographer shall not be liable for indirect loss or third-party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, the photographer’s liability (if any) shall be limited to rectifying such defect.
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
LICENCE
The Photographer shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The Photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.
COOPERATION & SCHEDULE
Both the client(s) and photographer acknowledge that punctuality and cooperation are crucial to achieving excellent photographic results. The photographer is not responsible for knowing the significance of specific guests. Formal photographs are scheduled to ensure that everyone is photographed according to the client(s)’ preferences. It is the client(s)’ responsibility to ensure cooperation during this time. If the wedding runs behind schedule (e.g., the bride arriving late to the ceremony or speeches running over), the agreed-upon set of photos cannot be guaranteed.
PHOTOGRAPHS AND IMAGES
The photographer will have sole discretion over the selection and editing of images. The client(s) acknowledge that re-editing any image is prohibited, as it would not accurately represent the photographer's artistic vision. While the photographer will ensure a pleasing colour balance, exact colour matching cannot be guaranteed. For images that are part monochrome and part colour, the colour choices will be based on the photographer's artistic interpretation and will be deemed correct.
The photographer cannot be held responsible for any images that may be missing from your personal selection of photos. While the photographer will strive to accurately capture your wedding day, there may be instances where certain spontaneous moments are missed due to the photographer's availability or unforeseen circumstances. In some cases, actions by guests may also hinder the photographer’s ability to capture specific images. If there is a key photo missing that you had expected, and it is determined that the photographer made an error, it will be addressed as a rare occurrence, and minimal errors will not be the photographer’s responsibility.
The photographer is not liable for how you personally interpret the final edited images. The photographs will be taken and edited in a style consistent with the portfolio, though factors like weather and location may influence the appearance and editing of the images. The photographer cannot be held responsible for factors such as people’s expressions, the appearance of buildings or décor, or any other content present in the images.
It is the client’s responsibility to understand that the photographer will photograph and select images based on his personal perspective and vision of the day. Should you desire a higher number of images focusing on specific aspects (e.g., more photos of guests/family versus detail shots), this should be communicated to the photographer prior to the wedding day. To maintain the photographer's creative integrity, no unprocessed images or contact sheets will be provided to the client, and any additional processing beyond the agreed number of images will incur an additional fee. The client acknowledges that any extra work will be added to the photographer’s current editing queue, and estimated delivery times will be provided upon the purchase of additional images.
RETOUCHING
Basic retouching (e.g., removal of spots) is included in all photography packages. Additional retouching and post-processing are available as optional extras. The final result and finish of any retouched image will be at the photographer’s discretion.
DELIVERY OF IMAGES
The final images will be completed and made available via a password-protected online gallery within 4-6 weeks after the wedding date. The gallery will remain accessible for a minimum of 12 months from the date the images are delivered. The client(s) are advised to keep a backup copy of all images. The photographer will make reasonable efforts to retain backup copies of the original and edited images for up to 18 months after the wedding date. After this period, the photographer cannot be held responsible if the client loses access to the images.
ENGAGEMENT SESSION
If the client(s) package includes an engagement session, or if they choose to add it to their package, the session will consist of a 2-hour photoshoot with a minimum of 20 final edited images. These images will be delivered via a password-protected online gallery, accessible through a link within 4-6 weeks after the session. The photographer and client(s) agree to schedule the session in advance, ideally 3-6 months before the wedding date. The location will be mutually agreed upon by the photographer and the client(s). The client(s) understand that failure to schedule the session with Adam Bird in advance may result in the forfeiture of the engagement session.
BOOKING FEE
A non-refundable booking fee of £500 is required when the client signs this contract. This fee will be deducted from the total price and secures the photographer's time and services for the wedding. The booking fee is non-refundable or transferable if the wedding is canceled. The client(s) agree to pay the £500 booking fee at the time of signing, with the remaining balance, including any expenses, due 30 days before the wedding. Full payment must be made before the wedding day, and all scheduled payments must be made on time. If payments are missed or delayed, the photographer reserves the right to cancel their services without refund of previous payments, at their discretion.
CANCELLATION
In the event the photographer is unable to attend the wedding due to circumstances beyond their control (e.g., illness, injury, crime, or unforeseen events such as flooding), the photographer will make every effort to arrange for a substitute photographer. If the photographer is unable to attend or if there is a total photographic failure, liability will be limited to a full refund of any fees paid. If a replacement photographer is found, a £250 fee will be deducted from any remaining balance or refunded if the balance has been paid in full.
If the client's photography package includes a second shooter and, in the unlikely event, only one photographer is able to attend the wedding, the client(s) will receive a refund of £400 from the remaining balance of their wedding package. If there is no remaining balance or if the balance is less than £400, the photographer will issue a refund of £400 minus any outstanding balance, within 30 days after the wedding date. The maximum refund for a second shooter is £400, and requests for a higher refund amount will not be honoured.
If the wedding is unable to proceed due to events like flooding, fire, or a pandemic, any payments made will be transferred to a rescheduled date. If a new date is not available, a refund will be issued, minus a £1000 cancellation fee.
Cancellation fees are as follows (the following amounts will be invoiced if the client(s) cancel their booking):
1 to 3 years before the wedding date: £200 cancellation fee
1 year before the wedding date: 20% of the total package cost
9 months before the wedding date: 35% of the total package cost
6 months before the wedding date: 50% of the total package cost
3 months before the wedding date: 75% of the total package cost
Less than 8 weeks before the wedding date: Full payment for the complete photographic coverage booked
All payments made before cancellation are non-refundable. The client(s) are strongly advised to purchase appropriate insurance to cover cancellation-related costs.
Cancellations must be submitted in writing.
RIGHT OF WITHDRAWAL
The photographer reserves the right to withdraw from the agreement in the event of new information or changes to the agreed circumstances that may impact their safety, travel plans (e.g., changes to the wedding location, travel restrictions, government travel advisories, quarantine measures, etc.), reputation (e.g., defamatory comments), or any other factors that may conflict with the photographer’s policies. Additional contributing factors may include non-cooperation, changes in location, facilities, or available times, missed appointments, and late payments.
If the photographer initiates the withdrawal, all fees will be refunded, excluding the booking fee.
REFUNDS
The photographer will not issue refunds nor accept returns or refusals to pay for any technically acceptable photographs provided. No exceptions can be made, as the photographer cannot be held responsible for individual preferences or opinions. Photographs may be withheld until the full payment for the client(s) package is received.
Any payments made in advance of your wedding are non-refundable.
CHANGE OF DATE
If the client(s) wish to change the wedding date, a £200 fee will apply for rescheduling, in addition to the original package price. If the photographer is unavailable on the new date, any payments already made will be non-refundable.
If the new wedding date is more than 12 months from the original date, the client(s) may need to rebook at the photographer’s current pricing for the new date. However, if the new date is within 12 months of the original date, the original package price will be honoured.
WEDDING INSURANCE
The photographer strongly recommends that the client(s) obtain wedding insurance to protect any payments made or to be made for their wedding. The photographer advises the client(s) to carefully review the terms and conditions of their wedding insurance and to keep copies of receipts from all wedding suppliers.
FINAL CONFIRMATION
By booking the photographer, the client(s) acknowledge that the photographer will document the wedding day according to their unique artistic style, as reflected in their portfolio.
